Terms & Conditions
Your contract is with Holiday Territory Ltd. A contract exists between us when we have confirmed you on our Holiday / tour booking / or any other travel related services of your choice and we have received your booking request and deposits. All correspondence/s in respect of holidays / Travel Service bookings should be addressed to Holiday Territory Ltd. Your reservation request will be confirmed upon receipt of the full payment due at the time of booking. Please be aware that some of our airfares and land arrangements need to be paid in full at the time of booking and carry a 100% cancellation charge. In these cases you will be notified at the time of booking. Although every effort will be made to confirm your request, please note that travel arrangements are not confirmed until you receive our written confirmation and Holiday Territory Ltd reserves the right to make changes if required. Before a booking is confirmed, Holiday Territory Ltd reserves the right to amend price of product due to any circumstances outside the control of Holiday Territory Ltd such as but not limited to changes relating to governmental action, increases in transportation costs (including schedule airfares and the cost of fuel) changes in any dues, taxes or fees chargeable for services (including landing taxes or embarkation / disembarkation fees at airports), increases in admission fees and hotel rate adjustments / availability. Advertised prices are also subject to seasonal changes, exchange rates and may vary slightly. Payments can be made via bank transfers, Visa – MasterCard, Cash payment to our offices in your city or by Cheque.
Please be aware that airfares need to be paid in full at the time of booking and carry a 100% cancellation charge. For all other services the cancellation fees in the next paragraph “Amendments and cancellation by clients” will apply.
Policy Regarding Cancellation By Client / No Show / Early Departure.
In case of cancellation of a holiday /travel services due to any avoidable/unavoidable reason/s Holiday Territory Ltd must be informed in writing. Cancellation charges would be effective from the date we receive letter in writing by the lead passenger addressed to Holiday Territory and cancellation charges would be as follows:
60 days & prior to arrival – 10% of the tour/service cost.
59 days to 30 days prior to arrival – 20% of the tour/service cost.
29 days to 15 days prior to arrival – 25% of the tour/service cost.
14 days to 08 days prior to arrival – 50% of the tour/service cost.
07 days & less, prior to arrival or no show – NO REFUND.
Please note – Irrespective of above mentioned cancellations slabs – in case of cancellation of tour services after the booking is made with us – a minimum 10% service charges would be applicable
In case of booking made during high peak season (Special seasons X’ Mas / New Year period – 15th Dec to 15th Jan) NO refund will be provided irrespective of the period.
In case you cancel the trip after commencement refund would be restricted to a limited amount that too would depend on the amount that we would be able to recover from the hoteliers and other service providers we patronize. For unused hotel accommodation, chartered transportation and missed meals etc. we do not bear any responsibility to refund.
In regard to refund of unused / unutilized services (which are paid for and cancelled in advance) the refund amount would be worked out on the basis of cancellation policy as described above and the money would be accordingly refunded to the person who has made the payment to us. Please note that the refund process may take 2 – 4 weeks due to banking procedures. If the refund is made to the credit card account OR to Bank account, the bank charges would be debited from the refund amount.
Policy Regarding Cancellation By Holiday Territory Ltd.
Holiday Territory Ltd reserves the right to cancel any confirmed booking in any circumstances, however, Holiday Territory Ltd will not cancel a Guaranteed Departure Product except in the unusual circumstances of force majeure, defined here as war, threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions, flight cancellation or any other external circumstances beyond the control of Holiday Territory Ltd Compensation is not available if Holiday Territory Ltd is forced to cancel or in any way change a tour due to force majeure but where Holiday Territory Ltd is unable to provide the tour booked, Holiday Territory Ltd is not responsible to deliver any service or liable for an service for an already booked package and is not liable to refund or compensate the customer. In the mentioned cases the refund of unused Vouchers or Holiday Bookings will be 10% of the paid amount.
All product information has been published by Holiday Territory Ltd in good faith and Holiday Territory Ltd will use its best endeavors to operate all products. Holiday Territory Ltd reserves the right to change any of the facilities and services described in its website and publications and to substitute alternative arrangements of comparable monetary value without compensation and accepts no liability for loss of enjoyment resulting from any change. Holiday Territory reserves its rights to change selected hotel to same category accommodation, due to any extraordinary circumstances.
Travel and Health Insurance
Adequate insurance is mandatory for all clients to cover at least but not limited to medical and repatriation expenses, loss of luggage, cancellation or curtailment of a Product and should not exclude any planned adventure activities from the time of booking for the full duration of the Product as a minimum. A client and their personal belongings are the sole responsibility of themselves. Holiday Territory accepts no liability on the client’s behalf where Holiday Territory Ltd has provided a product of a reasonable standard. Clients are fully responsible for arranging their own travel insurance. Should the insurers dispute their liability for any reason, the client will have recourse against the insurers only.
Our Liabilities & Limitations.
Please note that after the finalization of the tour/service cost, if there are any hikes in entrance fees of monuments/museums, taxes, fuel cost or guide charges by the Govt. of tour destination, the same would be charged as extra.
Holiday Territory Ltd act only in the capacity of tour operator on behalf of tour suppliers & tickets issued by us are issued subject to terms & conditions under which these services are provided by them.
All itineraries are sample itineraries, intended to give you a general idea of the likely trip schedule. Numerous factors such as weather, road conditions, the physical ability of the participants etc. may dictate itinerary changes either before the tour or while on the trail. We reserve the right to change any schedule in the interest of the trip participants’ safety, comfort & general well being.
Our rates are based on the prevailing rates as negotiated by us with suppliers. Suppliers retain the right to modify the rates without notice. In case of such changes the rates quoted before the modification, can be changed by us according to the modifications by suppliers.
We shall not be responsible for any delays & alterations in the program or expenses incurred – directly or indirectly – due to natural hazards, flight cancellations, accident, breakdown of machinery or equipments, breakdown of transport, weather, sickness, landslides, political closures or any untoward incidents.
We shall not be responsible for any loss, injury or damage to person, property, or otherwise in connection with any accommodation, transportation or other services, resulting – directly or indirectly – from any act of GOD, dangers, fire, accident, breakdown in machinery or equipment, breakdown of transport, wars, civil disturbances, strikes, riots, thefts, pilferages, epidemics, medical or custom department regulations, defaults, or any other causes beyond our control.
We do not have any insurance policy covering the expenses for accident, sickness, loss due to theft, or any other reasons. Visitors are advised to seek such insurance arrangements in their home country. All baggage & personal property/s at all times are at the client’s risk.
Passports & Visas
It is the client’s responsibility to obtain correct, current and valid passports and entry permits where required. Holiday Territory Ltd will not be liable for any consequence of any nature arising from the customer failing to ensure he / she has complied with such requirements. It is the responsibility of the clients to be in possession of a valid passport, visa permits, all necessary travel documents, vaccinations, preventative medicines and other medical certificates that may be needed to travel. Holiday Territory Ltd is not liable for damages arising from changes in regulations or laws to the necessary travel document requirements. Information about these matters is given in good faith by Holiday Territory Ltd but without liability. It is important that you check all details provided on your travel documentation are correct upon receipt. If there are any inaccuracies, please contact the Holiday Territory immediately. All passengers are/ will be personally responsible for ensuring they are in possession of the correct and necessary documentation prior to departure.
In the event the Client has a complaint about any of the product arrangements the client must raise the complaint immediately with a Holiday Territory Ltd employee or legal representative so that we can use our best endeavors to rectify the problem. Holiday Territory Ltd cannot rectify a problem it is unaware of. Failure to complain immediately will extinguish or at least reduce Holiday Territory’s liability to pay compensation. Although every effort will be made to resolve a complaint to the customer’s satisfaction, it is specifically recorded that Holiday Territory Ltd in no way accepts liability for any claim.
